DuPont Asbestos Trial Rescheduled

The asbestos-related trial against DuPont that was filed in the Jefferson County District Court of Texas has been rescheduled for April of this year rather than the original trial date which was set for February. The trial involves a contractor who developed mesothelioma and DuPont who was found to not be responsible for his disease even though the man worked for the company in 1966.

Mesothelioma is one of many diseases that can be caused by exposure to asbestos-containing materials. Other diseases caused by such exposure include lung cancer and asbestosis as well as severe respiratory problems.

Because of the long latency period associated with asbestos-caused diseases it is very difficult to find effective treatment options by the time such diagnosis occurs. In many cases such a disease will already be in its advanced stages of development by the time it is discovered.

In a previous trial held the jury found that DuPont was not responsible for Willis Whisnant Jr.’s development of mesothelioma but Whisnant was granted the opportunity for a retrial. That trial date was originally set for February 9th but has now been delayed.

There is no word as to why the delay occurred.

Texas State Agency Receives Air-Quality Testing Grant

The Texas Department of State Health Services has recently received a grant that will allow them to conduct air quality testing at public sites where renovations or demolitions are taking place. The Environmental Protection Agency awarded a total of $360,000 that will be used to determine if the presence of asbestos as well as other toxins exists at any such public sites throughout the state.

When asbestos is released into the air dangerous asbestos fibers may be inhaled by those in close proximately which could result in the development of a number of asbestos-related diseases. Such diseases include but are not limited to mesothelioma, asbestosis, and lung cancer.

Because these types of diseases typically do not show on diagnostic tests for twenty to fifty years there is only a very limited chance of finding effective treatment options for those diagnosed. Many times victims of such diseases will only live a short time following discovery.

According to officials states are in charge of ensuring that National Emissions Standards for Hazardous Air Pollutants are being enforced. It is also the responsibility of the states to ensure that contractors having an environmental license follow regulations regarding the removal of asbestos-containing materials.

Asbestos-Related Lawsuit Filed in Texas

A man residing in Texas has recently filed an asbestos-related lawsuit claiming that his relative’s development of and subsequent death from an asbestos-caused disease is the fault of 27 defendant corporations that the man worked for. Omar Rucker Phillips was employed as a pipefitter for a number of years. According to Curtis Blake Phillips who has filed the suit on behalf of Omar it was during this time that Omar was exposed to dangerous asbestos-containing materials that led to the development of his disease.

This is the second lawsuit filed due to Phillips’ development of asbestos-related diseases. Omar Rucker Philips himself previously sued for a non-malignant disease he developed as a result of his asbestos exposure.

Curtis Blake Phillips has cited a previous case in which a victim of exposure was able to sue a second time when he developed a second disease as a result of such exposure.

Asbestos exposure is known to cause a number of dangerous diseases including but not limited to mesothelioma, lung cancer, and asbestosis. Due to the long latency period associated with such diseases it is very difficult to find effective treatment options for those who have developed such a disease. In many cases by the time an asbestos-caused disease is discovered it is already in advanced stages of development.

Curtis Blake Phillips has stated that his relative’s death has caused his family to incur considerable debt due to high cost medical care as well as mental anguish.

In the suit Philips is seeking exemplary and actual damages in an unspecified amount.
